Refund Policy

 

Tickets are non-refundable.

 

Delivery/Shipping Policy/Will Call

 

If you have selected delivery through the mail, please allow at least fourteen days after placing your order for your tickets to arrive. For Fan Club Events, you will receive your tickets no later than 2 days prior to the show. For express delivery orders, please allow at least two business days for your orders to arrive. If you have not received your tickets within forty-eight hours of the event, please contact us at 1-800-514-3849. Etix will only ship tickets via Fedex or USPS to the billing address of the card holder. Occasionally, tickets may be available through will call for some events. Will call tickets are generally available one hour prior to the start time of the event. You will need to present the credit card used to purchase the tickets and a picture identification to pick up your tickets.

 

Terms and Conditions

 

Purchasers agree that any reproduction of a purchased ticket will be used solely for the ticket purchaser. No reproduction or alteration of the purchased ticket will be sold to a third party. Purchasers are bound by the laws of the State of North Carolina, and NBF reserves the right to pursue, to the fullest extent of the law, all penalties allowable for anyone caught counterfeiting, reproducing for sale, or altering tickets for unpaid or illegal entry into an event. If we are unable to verify or authenticate any information or tickets you provide during any registration, ordering, purchase, ticket posting, sale, authentication, delivery, payment, or any other process, or if we are no longer able to verify or authorize your credit card or bank account information, your tickets may be canceled, we may refuse to honor all pending and future ticket purchases made with those credit card or bank accounts and/or via any online accounts with those credit card or bank accounts. We may also prohibit you from using the Site.

 

Order Confirmations

 

After submitting payment information, if for whatever reason you do not receive an order confirmation through a page on the Etix site or a confirmation e-mail or you are experiencing an error message, it is your responsibility to confirm with Etix customer service whether your order has been processed. Etix will not be responsible for losses (monetary or otherwise) if you assume that an order was placed because you failed to receive confirmation.

 

 

Terms of Use

 

Violations

 

NBF may investigate any violation of these Terms, including but not limited to unauthorized use of the Site. NBF may pursue any legal action it deems necessary. The failure or delay of NBF to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

If NBF determines that you have violated these Terms or other applicable law, or for any other reason, we may cancel your account, delete any or all of your content, and prevent you from further accessing the Site. You will still be bound by these Terms. NBF shall not be liable to you or any third party for termination of your access to the Site or to your account, any information related to your account, and NBF will not be required to furnish any information related to your account to you. We may also cancel any order, including tickets already acquired through your order. We may refuse to honor pending and future purchases made from any and all accounts we reasonably believe may be associated with you, or cancel a ticket or order associated with any person we believe to be acting with you or on your behalf.

Disclaimer of Warranties

ALL MATERIALS AND CONTENT ON THIS SITE ARE PROVIDED “AS IS” AND NO GUARANTEES OR WARRANTIES OF ANY KIND ARE EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE. NBF MAKES NO WARRANTY THAT OUR SITE OR SERVICES PROVIDED WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. NBF IS NOT RESPONSIBLE FOR THE ACTIONS OR INFORMATION OF THIRD PARTIES AND YOU RELEASE NBF OF ANY CLAIMS AND DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH A CLAIM AGAINST ANY THIRD PARTY. Notwithstanding the foregoing, you may report violations of these Terms to NBF who may, at their discretion, investigate the claim and take necessary action.

 

Limitation of Liability

 

NBF SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES OR UNDER ANY LEGAL THEORY, WHETHER IN TORT, CONTRACT, OR OTHERWISE, WITH RESPECT TO OUR SITE, OR ANY OTHER SUBJECT MATTER OF THESE TERMS, AND YOU HEREBY WAIVE ALL RIGHTS TO SEEK DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY TYPE OTHER THAN OUT OF POCKET EXPENSES, AND ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. NBF SHALL HAVE NO RESPONSIBILITY FOR, AND HEREBY DISCLAIMS ALL LIABILITY ARISING FROM, THE ACTS OR OMISSIONS OF ANY THIRD PARTY SERVICE PROVIDER. THE FOREGOING LIMITATIONS SHALL ONLY APPLY TO THE FULL EXTENT ALLOWED BY LAW.

 

Indemnity

 

Should anyone bring a claim against NBF related to your use of the Site or your violation of these Terms, you agree to indemnify, defend, and hold NBF, any of our affiliates, and any of our officers, directors, employees, and agents, harmless from and against all claims, damages, losses, and expenses of any kind (including reasonable legal fees and costs). NBF reserves the right to take exclusive control and defense of any claim, and you agree to cooperate fully with NBF in asserting any defenses available.

 

Choice of Law

 

The terms of this agreement shall be governed by and in accordance with the laws of the State of North Carolina.

Dispute Resolution

In the event of any dispute or controversy arising from the use of this Site, the parties agree to first submit all issues to mediation under the procedures of the American Arbitration Association. In the event that mediation fails to resolve all issues, the parties shall submit all remaining issues to arbitration under the procedures of the American Arbitration Association; the prevailing party shall be entitled to reasonable attorneys' fees and expenses in accordance with those procedures. The venue of the mediation or arbitration shall be determined such that the party who commences the dispute resolution shall do so in the city where the other party has its principal place of business.

 

Invalid Provisions

 

Should any provision of these Terms be found by an arbitrator or court of proper jurisdiction to be invalid, the parties agree that the arbitrator or court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms shall remain in full force and effect.

We may also obtain information from other sources and combine that with information we collect about you. For example, our event sponsors may track visitors to their websites who clicked on a link in an email sent by us and they may share the aggregated data with us.

 

Information Use

 

1.    Internal Use:

We use your personal information to process your registration and provide you with the above-and-beyond customer service for which we are known. We use your personal information to organize and administer events and, if applicable, to provide results from events. In addition, in our constant effort to seek bottlenecks, we may use your personal information to improve the Services, to improve our marketing efforts directed at new and existing customers and to determine general information about visitors to our websites or applications.

 

2.    Communications With You:

 

We use your personal information to communicate with you about your events (either those for which you have registered or those which you have created), such as to send you a confirmation email when you register for an event and updates relating to that specific event. Also, you may submit your email address to us for a variety of reasons, including, but not limited to: registering for a sweepstakes, contest or survey; requesting that we notify you of new brands, events or products; signing up for newsletters and special offers. If you submit your email address to us, we use it to deliver information to you.

By registering for an event on our website and providing us with your email address, you expressly agree that we may communicate with you in the following ways: (a) provide updates and information relating to your event; (b) promote events that differ from the one for which you originally registered, whether produced by NBF or one of its affiliates, sponsors or partners or another unrelated entity; (c) promote products that differ from those which you have purchased; (d) provide NBF updates and information about NBF’s events or brands; and (e) provide information about the Services.

While we use industry-standard precautions to safeguard your personal information, we cannot guarantee complete security. 100% security does not presently exist anywhere online or offline.

IN NO EVENT SHALL NBF BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH A THIRD PARY’S UNAUTHORIZED ACCES TO YOUR INFORMATION, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, STRICT LIABILITY, TORT OR OTHER THEORIES OF LIABILITY, AND ALSO REGARDLESS OF WHETHER RFE WAS GIVEN ACTUAL OR CONSTRUCTIVE NOTICE THAT DAMAGES WERE POSSIBLE. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
